Die Emmy Noether-Nachwuchsgruppe arbeitet seit dem 1. April 2024 zum Thema „No representation without taxation' - Budgetrecht im Mehrebenensystem“ an der Juristischen Fakultät der Humboldt-Universität zu Berlin. Dr. Ruth Weber wurde im November 2023 in die Emmy Noether-Förderung der Deutschen Forschungsgemeinschaft aufgenommen.  Sie leitet die Gruppe, die derzeit aus dem wissenschaftlichen Mitarbeiter Lukas Märtin und den studentischen Mitarbeiter:innen Hanna Léna Tikk und Niklas Kuberski besteht. Kooperationspartner:innen verschiedener europäischer Universitäten unterstützen die Gruppe.
Die Gruppe analysiert das Budgetrecht im Mehrebenensystem, insbesondere im Verhältnis zwischen nationalstaatlicher und europäischer Ebene. Ausgangspunkt der Forschung sind aktuelle Entwicklungen in der Europäischen Union, auf Krisen mit Unterstützungsfonds zu reagieren – etwa 2020 mit der Einrichtung eines Wirtschaftsaufbaufonds während der Covid19-Pandemie. Diese Entwicklungen sollen europa- und verfassungsrechtlich eingeordnet werden.
Seit den Anfängen der europäischen Integration in den 1950er Jahren hat sich der Haushalt der Europäischen Gemeinschaften bzw. der Europäischen Union erheblich verändert. Ob europäische Maßnahmen wie der Wirtschaftsaufbaufonds „NextGenerationEU“ oder der Europäische Stabilitätsmechanismus das Budgetrecht des Deutschen Bundestages substantiell einschränken, war seit der Euro- und Finanzkrise immer wieder Gegenstand von Verfahren vor dem Bundesverfassungsgericht. Die Forschungsgruppe untersucht zunächst die Entwicklung des Budgetrechts als parlamentarisches Recht in der deutschen und europäischen Rechtsordnung. Im Mittelpunkt steht dabei das Verhältnis von demokratischer Repräsentation und öffentlichen Finanzen. Darüber hinaus wird die Bedeutung des Budgetrechts in föderal und zentralistisch organisierten politischen Systemen verglichen.
Die Forschung baut auf dem Öffentlichen Recht und seinen Grundlagen auf, insbesondere der Verfassungsgeschichte und der Rechtsvergleichung. Ziel der Nachwuchsgruppe ist es, Forschungslücken im Bereich des Haushalts- und Eigenmittelrechts der Europäischen Union zu schließen und ein differenziertes Bild von der Bedeutung des Budgetrechts in Mehrebenensystemen zu zeichnen.

About the group

The Emmy Noether Junior Research Group is working on the topic of “‘No representation without taxation’ – Budgetary powers in the multi-level system” at the Faculty of Law at Humboldt-Universität zu Berlin. It has started its work in April 2024. Dr Ruth Weber has been accepted into the German Research Foundation’s (DFG) in November 2023. She is the leader of the group, which currently consists of research fellow Lukas Märtin and student assistants Hanna Léna Tikk and Niklas Kuberski. Co-operation partners from various European universities will support the group.
The group is analysing budgetary powers in the multi-level system, particularly the relationship between the national and the EU level. The starting point for the research are current developments in the EU to react to crises with support funds – for example in 2020 with the establishment of an economic recovery fund during the Covid19 pandemic. The group will analyse these developments in the light of national constitutional law and EU law.
Since the beginnings of European integration in the 1950s, the budget of the European Communities and the EU has changed considerably. Whether previous European policies, such as the recovery fund NextGenerationEU or the European Stability Mechanism, have substantially restricted the German Bundestag's budgetary powers has repeatedly been the subject of proceedings before the German Federal Constitutional Court since the euro and financial crisis. The research group first analyses the development of budgetary powers as parliamentary prerogative in the German and European legal systems. The focus will lie on the relationship between democratic representation and public finances. In a second step, the group will compare the significance of budgetary powers in federally and centrally organised political systems.
The research is based on public law and its foundations, in particular constitutional history and comparative law. The aim of the junior research group is to close currently existing research gaps in the area of budgetary and own resources law in the EU and to draw a differentiated picture of the significance of budgetary powers in multi-level systems.
